Re: Maris IT Development Clarifies Access to Credit Bureau Data and Fraud Prevention Policies.

Maris IT Development emphasises adherence to the National Credit Act, CBA Code of Conduct, and strict anti-fraud measures.

Maris IT Development (PTY) Ltd, a registered credit bureau and member of the Credit Bureau Association (CBA), wishes to clarify recent misconceptions regarding access to credit bureau data. The company operates under the jurisdiction of the National Credit Regulator (NCR), is aligned with ISO 27001_2002 and SOC2 standards and is subject to annual audits to ensure compliance.

Any registered business in South Africa (with a CIPC registration) has the legal right to access credit bureau data for credit scoring and vetting, and anti-fraud purposes. Maris IT Development maintains one of the strictest onboarding policies in the industry, with a primary focus on fraud detection and prevention.

Accessing or requesting consumer data under the National Credit Act (NCA) is known as “Prescribed Purpose”. This sets out when and under what circumstances a credit report may be requested. Contrary to some statements, consumer consent is generally required, with certain exceptions specified under the NCA.

One key exception relevant to fraud investigators is:

Fraud Prevention – Regulation 18(4)(b): Fraud detection and fraud prevention services.

Maris IT Development continues to support all businesses and investigative agencies in preventing and detecting fraud, while ensuring compliance with national regulations. For guidance on “Prescribed purposes” or fraud prevention services, Maris IT Development encourages institutions to consult the NCA and associated regulatory frameworks.

“Maris IT Development is committed to upholding the highest standards of data privacy and fraud prevention,” said Marius du Plessis, Director of Maris IT Development. “Fraud investigators, including CFE examiners and statutory agencies such as SAPS, may legally access credit bureau data without consumer consent only when the enquiry falls under a prescribed purpose in the NCA regulations.”
